This article examines the impact of this unique legal regime in selected areas of public competition law, in particular state aid law and public enterprise law. It examines how the combination of typical regulatory and trade law with competition law shaped by European Union law affects the competitive position of craft enterprises. Legal policy proposals will also be developed and measured against the higher law. | ||
| 520 | |a Das Handwerk hat in Deutschland eine große wirtschaftliche Bedeutung und ist unverzichtbar, um eine Vielzahl von Herausforderungen der Gegenwart und Zukunft zu meistern. Gleichzeitig ist es mit dem Handwerksrecht einem Rechtsregime unterworfen, das in Europa einzigartig ist. Die vorliegende Arbeit untersucht die Auswirkungen dieses einzigartigen Rechtsregimes in ausgewählten Bereichen des öffentlichen Wettbewerbsrechts, insbesondere des Beihilferechts und des Rechts der öffentlichen Unternehmen. Untersucht wird dabei, wie sich das Zusammentreffen von typisch ordnungs- und gewerberechtlichem Handwerksrecht und unionsrechtlich geprägtem Wettbewerbsrecht auf die Wettbewerbsposition von Handwerksunternehmen auswirkt. Dabei werden auch rechtspolitische Vorschläge erarbeitet und am höherrangigen Recht gemessen. | ||
