Summary

Within the framework of international cooperation, states can transfer the conduct or continuation of criminal proceedings to another state (e.g. the suspect's home state). In Germany, however, this cooperation instrument is not regulated by law. The study analyses the existing legal framework in international and EU law as well as the corresponding regulations in Switzerland and the Netherlands and outlines a legal and procedural framework for this cooperation instrument.
Im Rahmen der internationalen Zusammenarbeit können Staaten die Durchführung bzw. Fortführung eines Strafverfahrens auf einen anderen Staat (z.B. den Heimatstaat des Täters) übertragen. In Deutschland ist dieses Kooperationsinstrument indes nicht gesetzlich geregelt. Vor dem Hintergrund der zu erwartenden Reform des deutschen Rechtshilferechts analysiert die Studie den bestehenden Rechtsrahmen im Völker- und Unionsrecht sowie die entsprechenden Regelungen in der Schweiz und in den Niederlanden und skizziert, wie eine gesetzliche Regelung in Deutschland aussehen könnte.
