La población desplazada en Colombia: ¿Hacia un nuevo estado de cosas inconstitucionales?

The present work leads us to a broad reflection on the most vulnerable populations that afflict Colombian society; that is why today we dedicate this research to them in order to debate and question the actions of state authorities regarding the fulfillment of fundamental rights that so far have remained in a perpetual constitutional transgression, which has led to the declarations of unconstitutional states of affairs -ECI- and yet these have not been sufficient for the satisfaction and solution of their problems. It is with the above that we refer to the name of this book, because from the evident non-compliance of the structural failures generated from the declaration of an ECI, we postulate the importance of restructuring it with new measures, proposing the new unconstitutional state of affairs -NECI- and thus ending the prolonged transgression that has been occurring on a massive scale against fundamental rights.

La presente obra nos conduce a una amplia reflexión frente a las poblaciones más vulnerables que aquejan la sociedad colombiana; es por esto que hoy les dedicamos esta investigación con el fin de poner en debate y tela de juicio las actuaciones de las autoridades estatales respecto al cumplimiento de los derechos fundamentales que hasta el momento se han quedado en una perpetua transgresión constitucional, lo cual ha llevado a las declaratorias de estados de cosas inconstitucionales-ECI- y que sin embargo estos no han sido suficientes para la satisfacción y solución de sus problemas. Es con lo anterior que referimos el nombre de este libro, pues a partir del evidente incumplimiento de los fallos estructurales generados a partir de la declaratoria de un ECI, postulamos la importancia de la reestructuración de este con nuevas medidas, planteando el nuevo estado de cosas inconstitucional -NECI- y así terminar con la prolongada transgresión que se ha venido presentando de forma masiva frente a los derechos fundamentales.
