| Summary: | The thesis analyzes Georg Wilhelm Friedrich Hegel's contribution to the German codification debate in the 19th century and its potential for a modern theory of codification. According to Hegel, codification means abstraction and system formation based on the actual, with respect to the reasonable law. On this basis, codification is a constant process and as much a requirement of a civilized society of free citizens as it is a contribution to its realization. Die Studie erschließt die Kodifikationstheorie Georg Wilhelm Friedrich Hegels für aktuelle rechtstheoretische Diskussionen. Sie zeigt, dass Hegels Äußerungen zum - bis heute maßgeblich mit den Protagonisten Friedrich Carl von Savigny und Anton Friedrich Justus Thibaut assoziierten - Streit um die Möglichkeiten einer systematisierenden Verschriftlichung des bürgerlichen Rechts nicht lediglich als zeitbezogene Invektive zu verstehen sind. Sie sind vielmehr eng mit Hegels rechtsphilosophischem Programm verknüpft: Die Abfassung eines formell und materiell allgemeinen Gesetzbuchs ist nach Hegels Auffassung Grundlage von Freiheit, juristische Systembildung ist Aufgabe der Philosophie, seine Grundlinien der Philosophie des Rechts sind Beispiel für das denkende Erfassen des Rechtsstoffs, das einer Kodifikation zugrunde liegen muss. Die philosophische Zeitlosigkeit der Anforderungen, die Hegel an ein Kodifikationsprojekt stellt, lässt schließlich Aussagen über aktuelle Systembildungsversuche auf der Ebene der Europäischen Union zu. Insbesondere kann Hegels Theorie die Ermutigung entnommen werden, durch rechtsphilosophische Systematisierung zur Suche nach einheitlichen Strukturen beizutragen, auf deren Basis sich ein einheitsstiftendes Narrativ entfalten kann. |
