| Summary: | »Normative Legitimacy of Law, Morality and Human Rights in the Light of the Positivist Separation Thesis«: On the basis of the positivist separation thesis, this study provides in-depth answers to the question of the manner in which state law, international law, morality and human rights can be considered normatively legitimate and what this legitimacy means in each case. The focus is not on specific substantive criteria of legitimacy, such as democratic procedures or certain notions of justice. Rather, the question is more fundamentally about the formal conditions of legitimacy. Normative Legitimität wird häufig verkürzt mit moralischer Anerkennungswürdigkeit gleichgesetzt. Eine Normenordnung kann aber auch nach anderen als nach moralischen Maßstäben als legitim gelten, wie etwa nach rechtlichen Kriterien. Auf der Grundlage der positivistischen Trennungsthese gibt diese Studie vertiefte Antworten auf die Frage, inwiefern staatliches Recht, Völkerrecht, Moral und Menschenrechte als normativ legitim gelten können und was diese Legitimität jeweils bedeutet. Dabei geht es nicht um bestimmte materielle Kriterien von Legitimität wie bspw. demokratische Verfahren oder bestimmte Gerechtigkeitsvorstellungen. Vielmehr wird grundsätzlicher nach den formalen Bedingungen von Legitimität gefragt. Man dringt dabei zum Charakter der rechtlichen und der moralischen Normativität vor, zur Natur ihrer Geltung und Verbindlichkeit. Mit Blick auf die Geltungsgründe von Recht, Moral und Menschenrechten wird ein Beitrag zu einem differenzierteren Verständnis des Legitimitätsbegriffs geleistet. |
