To this end, the author primarily examines the individual case-related balancing practice, analyses the respective judicial formation of balancing criteria also with regard to the influence and the respective consideration of the case law of the ECJ and ECtHR and evaluates the necessity and degree of harmonisation of the area of tension. | ||

Neben einer umfassenden Bestandsaufnahme beider Rechtsordnungen, hinterfragt die Arbeit die jeweiligen nationalen Lösungen im Vergleich und überprüft diese auf deren Aktualität und Praktikabilität in der gegenwärtigen Medienwirklichkeit. Dafür untersucht die Autorin vor allem die einzelfallbezogene Abwägungspraxis, analysiert die jeweilige richterrechtliche Bildung von Abwägungskriterien auch in Hinblick auf den Einfluss und die jeweilige Berücksichtigung der Rechtsprechungen von EuGH und EGMR und evaluiert Notwendigkeit und Grad der Harmonisierung des Spannungsfelds.
