Summary:»South Tyrol's Minority Protection System. Fundamentals, Developments and Current Challenges from an International and Constitutional Law Perspective« South Tyrol is a model for the resolution of minority conflicts based on a complex interplay of international and constitutional law. This book sheds light on this minority protection system from the Austro-Italian Paris Agreement in 1946 up to the present and is thus a handbook for this system. In addition, it looks at who may represent the German and Ladin minorities under international law and how limitations of the autonomy after the 2001 reform of the Italian Constitution can be reversed.
Südtirol ist ein Paradebeispiel für die friedliche Lösung von Minderheitenkonflikten. Sein Erfolg beruht auf einem komplexen Zusammenspiel von völker- und verfassungsrechtlichen Instrumenten und Schutzregelungen. Die Arbeit beleuchtet dieses facettenreiche Minderheitenschutzsystem in seiner Gesamtheit - vom österreichisch-italienischen Pariser Vertrag 1946 über den dazu vor der UNO entbrannten Streit bis hin zu den Entwicklungen der letzten Jahre. Als aktuelle Herausforderungen des Schutzsystems wird zudem erstmals analysiert, wer die deutsch- und die ladinischsprachige Minderheit heute in völkerrechtlicher Hinsicht vertreten darf, und wie die zahlreichen Einschränkungen der Autonomie, die das Land nach einer Reform der italienischen Verfassung im Jahr 2001 hinnehmen musste, wieder rückgängig gemacht werden können. Damit leistet die Arbeit nicht nur einen Beitrag zu aktuellen politischen Fragen, sondern dient zugleich auch als Handbuch zum Südtiroler Minderheitenschutzsystem.
