The purpose of this study to determine the application of legislation by judges and according to Islamic law in the permit polygamy and to determine the legal considerations the judge in determining the verdict No.1187 / Pdt.G / 2013 / PA BPP. The research method uses doctrinal-normative approach. Source of data derived from secondary data of primary and secondary sources of law. Data were collected by library study and then the data were analyzed by qualitative analysis. The results showed that the application of laws and regulations and in accordance with the Islamic law permits polygamy refers to the Qur'an Surat An-Nisa ', paragraph 3, 23, 127, 129, and Sunnah, as well as schools and scholars of tafsir Al- Qur'an as well as the positive law in Indonesia refers to the compilation of Islamic law which is in Article 55, 56, 57, 58, 59, paragraph (2), Law No. 1 of 1974 on Marriage, namely in Article 4, paragraph 5 (2), Government Regulation No. 9 of 1975 Article 42, 43, 44, 45. Legal considerations Surakarta Religious Court judges in deciding the case the permission for polygamy, which the judge has to decide the case using the basic Applicant concerned will conduct prohibited by religious norms if the Petitioner is not polygamy Petitioner and Respondent as his wife had been approved and would not mind Applicant married again (polygamy) as Al-Qur'an Surat an-Nisa verse 3.
