Summary

This study aims to find the principle of specialty and publicity in the consumer financing agreement with fiduciary guarantee made by the Notary Office in accordance to Law No. 42 of 1999 on fiduciary and identify any obstacles that arise. This research method through empirical juridical approach to data sources in the form of secondary data that is the source of primary law, secondary and tertiary and primary data in the form of interviews. Data were collected by literature study and interviews. Data analysis techniques with qualitative analysis. The results showed fiduciary made in compliance with the principle of specialty and publicity in accordance with Law No. 42 of 1999 and the issuance of the certificate of fiduciary numbered W13.00046268.AH.05.01 by the Ministry of Justice and Human Rights of the Republic of Indonesia. Barriers that arise are the current bottleneck fiduciary deed that any errors or incomplete data files so delayed, while the current bottleneck online registration is sometimes impaired, can not access them, causing a delay in the registration of objects fiduciary.
