| Summary: | Bank Muamalat Indonesia is one of Indonesian banks which running the system with sharia system. As a financial institution that implement the sharia system in every transaction, including the cooperation transaction using capital borrowing (qarḍ), in accordance with what has been stated by National Sharia Council (DSN), which became the benchmark in any transactions executed by the Bank Muamalat Indonesia. At practice level, Bank Muamalat Indonesia does'nt always carry out transactions only with Muslims, but also execute transactions with customers of non-Muslims as well, especially in areas where the majority of the population is not Muslim, like in Bali, there is a cooperation transaction using loan capital between Bank Muamalat Indonesia and CV. Prabu Tirta Gunung where the religion of owner of the CV. Prabu Tirta Gunung is Hindu. This research aims to determine the form of contract that occurred between Bank Muamalat Indonesia and CV. Prabu Tirta Gunung at district Jembrana Bali as well as to analyze the forms of the contract. This study is a qualitative research and the data sources used were obtained through interviews, documents, and books that correspond with this research to reinforce the notion in this study. Analysis of data used by the author in this study is a qualitative descriptive analysis. The results of the research shows that the form of the cooperation agreement between Bank Muamalat Indonesia and CV. Prabu Tirta Gunung is a qarḍ contract, because CV. Prabu Tirta Gunung borrow some money as venture capital from Bank Muamalat Indonesia. However in some instances, the qarḍ contract is modified for non-Muslim customers, so qarḍ contract that has been stated National Sharia Council (DSN) needs to be modified. The additional for the qarḍ contract implemented by Bank Muamalat Indonesia is the proof of ḥalāl products such as ḥalāl certificate from MUI Bali, and also requires their employees to be constituted at least four Muslims, and the last requirement is to prohibit the entry of animals into the plant, such as dog or pig. |
