| Summary: | This study aims to determine the construction of the law in executing the Letter of Attorney Imposing Mortgage Power (SKMHT) as a collateral credit, the problems that arise, and the completion of those problems at Bank BRI branch Sragen Sepat unit. The method used in this study is empirical juridical type included in descriptive qualitative. The data sources of this study are the primary data in which gotten from the interview and the secondary data which is gotten from the primary and secondary juridical data. The techniques of collecting data used in this study are observation and interview, afterwards, analyzed with a qualitative tool. The result of the study shows that Attorney Imposing Mortgage Power (SKMHT) is used by the time the absence of the debtor in giving Granting Mortgage Deed (APHT) legalized by the notary based on the Pasal 15 Undang-Undang No. 4 1996 about the Mortgage of the Land and the Properties Related to the Land. Moreover, the problems arisen from the implementation of the Attorney Imposing Mortgage Power seen from the period of time in the process of making the Letter of Attorney Imposing Mortgage Power (SKMHT) is too short and relatively needs a lot of money in the process of making the Granting Mortgage Deed (APHT). |
