TIPE PERTANYAAN, RESPON DAN PRAANGGAPAN YANG MUNCUL PADA INTERVIU INVESTIGATIF KEPOLISIAN

Penelitian ini dilakukan untuk mengetahui tipe pertanyaan, respon dan praanggapan yang muncul dalam proses interviu investigatif. Tipe pertanyaan yang diajukan penyidik terhadap terperiksa (saksi) akan berbeda dari apa yang ditanyakan pada terperiksa (tersangka). Begitupun respon yang diberikan oleh terperiksa terhadap pertanyaan tersebut berbeda bergantung pada penafsiran yang ada dalam pikiran mereka. Terperiksa memiliki praanggapan terhadap pertanyaan penyidik begitupun penyidik, namun makna sebenarnya dari suatu tuturan ada dalam pikiran penutur itu sendiri. Metode yang digunakan dalam penelitian ini adalah deskriptif kualitatif. Data diperoleh dari hasil transkripsi interviu investigatif dua kasus berbeda pada saat pengambilan BAP. Dari 113 pertanyaan yang diajukan penyidik kepada terperiksa kasus tindak pidana penipuan dan penggelapan penulis mendapati adanya 43 pertanyaan tertutup sedangkan dari 216 pertanyaan yang diajukan oleh penyidik kepada terperiksa kasus pencurian mobil dump truck penulis mendapati 36 pertanyaan serupa. Untuk pertanyaan terbuka, pada kasus pertama ada 70 pertanyaan tipe ini yang dibagi ke dalam 5 pertanyaan reflektif, 10 pertanyaan direktif, 40 pertanyaan langsung, 3 pertanyaan penilaian sendiri, dan 12 pertanyaan mengarahkan dan pada kasus kedua terdapat 180 pertanyaan yang terbagi menjadi 11 pertanyaan reflektif, 9 pertanyaan direktif, 69 pertanyaan langsung, 5 pertanyaan penilaian sendiri, 8 pertanyaan diversi, dan 78 pertanyaan mengarahkan. Perihal respon yang diberikan terperiksa bergantung pada tipe pertanyaan yang diajukan penyidik sedangkan praanggapan yang dimiliki penyidik saat mengajukan pertanyaan bisa jadi ditolak atau diterima bergantung pada jawaban/ respon terperiksa. This research was conducted to find out what types of questions, responses and presuppositions emerged in investigative interviews process. Types of questions employed by the investigators to witnesses would be different from those employed to suspects. Indeed, responses given by the interviewees (suspects and witnesses/complainants) would be different also, depended on the interpretation in their mind. Suspects and witnesses had their own presupposition towards investigators' questions, even though the intended meaning of an utterance was in the speaker's mind (the investigator's mind). The method employed in this research was descriptive qualitative. Data were gained from the transcription of investigative interviews of two different cases. From 113 questions conveyed by the investigator to the witness (in this case the complainant) of the criminal act of fraud and embezzlement, the writer found out 43 close-ended questions, while from 216 questions asked by the investigator to the suspect of dump truck stealing, there were 36 close-ended questions. For open-ended questions, there were 70 questions in this type, divided into 5 reflective questions, 10 directive questions, 40 direct/pointed questions, 3 self-appraisal questions, and 12 leading questions. On the other hand, in case of fraud and embezzlement, there were 180 questions, divided into 11 reflective questions, 9 directive questions, 69 direct/pointed questions, 5 self-appraisal questions, 8 diversion questions, and 78 leading questions. About responses given by the interviewees (the suspect and the witness/complainant), it depended on the types of questions asked by the investigators. Meanwhile about the investigators' presuppositions, it can be accepted or rejected based on interviewees' response.
