| Summary: | ABSTRACT The policy is written evidence for an insurance agreement, provided that it is made in the good faith of the two parties who entered into the agreement. In addition, the policy is also pqroof of guarantee from the Insurer to the Insured to compensate for losses that the Insured may experience due to unexpected events, as well as proof of payment of insurance premiums by the Insured to the Insurer as remuneration for the Insured's guarantee. The facts prove that there are many cases where the Insurer unilaterally canceled the policy as a form of refusal to pay claims and did not want to give the sum insured to the beneficiary. The purpose of writing this thesis is to find out about the basis for the insurer to unilaterally cancel the insured's life insurance policy, the procedure for submitting life insurance claims and to find out the position of the policy as an agreement between the insured and the insurer in the Supreme Court decision. The method used is normative research, this research is aimed at statutory regulations, both in general and specifically. So it can be concluded that the policyholder who made a misrepresentation, where there was a hidden information about the health condition when filling out the insurance application form in the life insurance agreement could result in the termination of the agreement. |
