| Summary: | The purpose of this study is to investigate the evidence in a conspiracy. This research scope is the case of the Trans Jakarta bus procurement. Unfair business competition will result in the tendency of business firm to exploit consumers. One form is conspiracy to limit or rigged business competition (conspiracy in restraint of business) in tenders. The results obtained are that in this case, from the examination of the participants and the tender committee there were indications of violations of Article 22 of Law Number 5 Year J 999 related to bid rigging. The method used is juridical normative by obtaining data on the decisions of the Business Competition Supervisory Commission Council (KPPU), books and journals as well as related regulations. The conclusion of this research is the consideration of the KPPU Council in deciding the proof of tender conspiracy in accordance with Article 22 which is a rule of reason. The proof in a conspiracy can be very clear, as happened in the case of the Trans Jakarta bus procurement, namely the equality of access using the same IP address. However, the evidence can be quite vague, namely the existence of a previous cooperative relationship that can happen to any business firm. It is a challenge for KP P U in determine violations with rule of reason in its nature, to continue to have to improve its competence in overcoming and enforcing the law in cases ofbid rigging. |
