520 | |a The phenomenon of the spread case of Covid-19 in Indonesia has grown rapidly, this certainly has a negative impact on employment and the weakening of the Indonesian economy which has real implications that must be faced by many companies to terminate workers/laborers in Indonesia on a large-scale. Article 164 and 165 of Act No. 13 of 2003 on Manpower, more or less states that a company has the right to terminate employment relations with workers if a company experiences force majeure or is in a state of force. In principle, when a force majeure occurs, the responsibility for all compensation and claims will be eliminated and there will be no compensation for the cost of losses in the event of a force majeure or an accidental event. This study aims to determine the law regarding termination of employment, which can be categorized as a reason for force majeure due to the condition of the Covid-19 Pandemic which has been said to be a national disaster and provides information on legal protection for workers/laborers who have been terminated by force majeure. This study uses a normative juridical approach. Research that focuses on juridical aspects which focuses on library research (legal science), regulate substantially because many companies terminate their employment during the covid 19 pandemic due to force majeure.
