Summary:This research aims to compare Inclusive Education in Indonesia with the law of The Every Student Succeds Act (ESSA) and Individuals With Disabilities Education Act (IDEA) used by persons with disabilities in the United States of America (USA). The main problem of this research is how to improve the right of students with special needs in Indonesia and relate to funding by learning from the USA's regulations. This type of research is a normative juridical research. The type of data used is qualitative data. The result of this research the educational practice for persons with disabilities in Indonesia has been through three types of educational institutions, namely Special Schools (SLB), Special Primary Schools (SDLB), and Integrated Schools. Then transferred to Inclusive Education. Meanwhile, education for people with disabilities in the United States is complemented by early intervention, related services, special education, and programs that support the success of education in America. In addition, section 611 of Individuals With Disabilities Education Act (IDEA) regarding the education budget for persons with disabilities must also be added to the new paragraph of article 49 of Law Number 20 of 2003. Such actions ensure the true implementation of education for persons with disabilities. This research's main contribution is to provide legal grounds recommendations for the Government to maximize the educational rights of people with special needs.
