| Summary: | The purpose of writing this scientific paper is to find out the judge's considerations in deciding the criminal case of desertion in absentia before a period of six months which is calculated from the transfer of the case to the court and to find out the urgency of the regulations regarding the criminal act of desertion in which the defendant is no longer found. The research method used is normative juridical or literature study, namely the study of legal norms and principles contained in laws and regulations, or legal regulations outside the law, the existence of a legal vacuum, overlapping between norms, study. By using a statutory approach, a case approach, and a conceptual approach. The conclusion of this study is the judge's consideration in deciding the criminal case of desertion in absentia before a period of six months because it does not reflect the principles of fast, simple, and low-cost justice. In addition, the judge used SEMA Number 2 of 2014 and SEMA number 1 of 2017 as legal guidelines for desertion procedures in absentia. It is very important to reformulate the regulation regarding the criminal act of desertion in which the defendant is no longer found. |
