Industrial Design is part of Intellectual Property Rights. In order to obtain protection for the rights of Industrial Designs, Designers must register them with the Directorate General of Intellectual Property. One of the requirements that must be completed is an element of novelty from a design work. The assessment of the novelty element can be seen from the industrial designs registered are new and original designs and have not been published or used before. In this case PT. Total Asri Sumber Alam filed a lawsuit for the Revocation of the industrial design to PT. Aneka Boga Citra but the Plaintiff itself has not registered its Industrial Design but the judge granted the Revocation claim, the problem in this thesis is How to Measure the Principle of Novelty in Industrial Design Rights and How to Cancel Industrial Designs About the "Packaging" of the Red Ginger Drink Amh. This research employs the theory of Legal Protection and Legal Certainty. It is included into normative juridical category with analytical description. It uses secondary data source. The secondary data consist of 3 (three) data sources; namely, primary, secondary and tertiary legal materials. Library research is applied as the data collecting method. The instrument used to collect the data is documentation study. The data analysis is done qualitatively with an emphasis on deductive method. The results of the research indicate that there are multiple interpretations regarding the meaning of the word "not the same" regarding the novelty element in Law Number 31 of 2000 concerning Industrial Designs and the lack of supervision by the Directorate General of Intellectual Property Rights (DJKI) in substantive examination of the novelty element in the Industrial Design application which lead to a dispute over the revokenation of the Industrial Design registration application submitted by PT. Total Asri Sumber Alam to Industrial Design owned by PT. Aneka Boga Citra. The DJKI Official should carry out a substantive examination in every application for an Industrial Design to minimize disputes over the revokenation of an Industrial Design application.
