Patent could be imposed as the object of fiduciary guarantee according to the Article 108 verse (1) Patent Statute Act 13/2016. However, this thing cannot be done for there is no legal certainty. The purpose of this research is to examine the implementation of the imposition Patent as the object of fiduciary guarantee that grants legal certainty for the inventor and the financial institution. This research uses the juridical normative method based on qualitative analysis and content analysis. This research uses the analytical descriptive writing technique. The conclusion of this research is obligated to find the valuation method for appraising the Patent Right that will be made as the object of Fiduciary Guarantee, Appraisers for Patent Right and also the formulation of the Government Regulation of terms and procedure of Patent Right as the object of Fiduciary Guarantee that grant the legal certainty for the inventor and financial institutions.
