| Summary: | Evidence in the process of eradicating corruption is not an easy thing considering that corruption is a serious crime, along with the times, it has led to many corruption crimes with new strategies, especially gratification, namely gratification in the form of sexual services. in the trial considering that in Indonesia, problems related to sexuality are very taboo to be discussed in public. What is also a further problem is that in the Corruption Eradication Act, especially in the explanation of Article 12B paragraph (1), it is not explicitly stated that sexual services are included in the category of criminal acts of gratification. Therefore, the author raises issues related to sexual gratification in the eradication of corruption. With the formulation of the problem: 1.) How is the evidence related to gratification in the form of sexual services according to the criminal procedure law in Indonesia? 2) How is the expansion of the meaning of gratification in the explanation of Article 12 B Paragraph (1) in Law Number 20 of 2001 in conjunction with Law Number 31 of 1999 concerning Eradication of Criminal Acts of Corruption? In this study, the author uses a normative juridical research method with a statutory approach as well as a case approach in the field. From the results of the study obtained evidence related to gratification in the form of sexual services referring to the Criminal Code and the Criminal Act of Corruption. Meanwhile, the expansion of the meaning of gratification is conditional depending on the current developments. then sexual gratification can be included in Article 12B paragraph (1) as long as the elements of the crime have been fulfilled and can be proven. |
