| Summary: | Women become the majority of victims of criminal rape because they are often perceived as weak and vulnerable individuals. Violent mental tremors often occur in women who are victims of rape, and sometimes they can also turn them into abusers. When defending the honor of his chastity, he is forcibly inflicting physical harm on the perpetrator even to the point of losing his life. The act of murder committed by the woman could be categorized in a coercion plea, as is already stated under article 49 (1) and (2) the penal code (criminal law). The purpose of this study is to explain legal protection for female perpetrators of murder as a defense against rape crimes, and the role of law enforcement officers in carrying out a fair legal process against female perpetrators of murder as a defense against criminal rape. This study uses a normative juridical method that can produce primary data, namely legal materials consisting of statutory regulations, such as Law no. 39 of 1999 concerning Human Rights, Law no. 13 of 2006 concerning the Protection of Witnesses and Victims, which is currently Law no. 31 of 2014, which ultimately resulted in secondary data for this research. Studies have shown that women's legal protection as both a victim and a perpetrator still require a stronger law umbrella to shelter them. Law enforcement officials are also expected to be able to objectively assess and apply the applicable legal rules, to provide fair legal protection for women as both victims of a crime. |
