Summary

This research aims to discuss the urgency of regulating the Victim Impact Statement in criminal acts of terrorism in the Indonesian criminal justice system and to compare the laws governing the Victim Impact Statement in New Zealand and in Indonesia. This research is a type of normative juridical research using a statutory, comparative, and conceptual approach. The results of this study show that the Victim Impact Statement can make victims have a stronger position in the Indonesian criminal justice system. This arrangement can be made by adjusting the implementation of the Victim Impact Statement as regulated in New Zealand, namely before the judge imposes a sentence on the defendant. In addition, a Victim Impact Statement can also be submitted after a series of readings of the indictment. The aim is to prevent judges from being trapped in the subjectivity of the Victim Impact Statement itself.
