This study aims to analyze the form of the abuse of diplomatic immunity and legal consequences for Nigerian Diplomat attacks on Indonesian Immigration Official according to the 1961 Vienna Convention on Diplomatic Relations. In this study, normative legal research was used with a statute approach and a case approach. Sources of data used are secondary data obtained through library research. Data is analyzed qualitatively then generated in the prescription form to analyze whether an event is true or not according to a legal point of view. Based on the results of this study, the author concludes that there is an abuse of diplomatic immunity from the criminal jurisdiction of the receiving State as regulated in Article 31 of the 1961 Vienna Convention that committed by violating the laws and regulations of the receiving State as regulated in Article 41 of the 1961 Vienna Convention which requires to respect the laws and regulations of the receiving State without prejudice to their privilege and immunities. The act of not being cooperative with Official and carrying out attacks on Official may be subject to Article 170 paragraph (1) of the Indonesia Criminal Code, which could bring legal consequences in the form of a declaration of persona non grata to the diplomatic representative and give the obligation of responsibility according to the provisions in the Responsibility of States for Internationally Wrongful Acts also provide a guarantee that there will be no repetition of the actions that have been taken.
