Summary:The implementation of fintech, which is still relatively new in Indonesia, allows many people who still feel foreign to technology-based lending and borrowing transactions. In managing resources in the development of a country's economy, it is indispensable to have management rules that are integrated and directed and can also be used to increase the community's welfare to the maximum. The implementation of this peer to-peer lending fintech can cause a problem in the future. The issues that arise are : 1) How is the implementation of peer-to-peer lending related to the regulation from the Financial Services Authority Number: 77/POJK.01/2016 regarding information technology-based lending and borrowing services? 2) What is the legal protection for users of the peer to-peer lending platform in lending and borrowing money transactions, and what about settlements that can be taken in the event of an unlawful act ? by using a normative juridical approach research method, it was found that 1) The application of Peer to Peer Lending is stated in Bank Indonesia Regulation Number 19 12/PBI/2017 concerning the Implementation of Financial Technology, but the precautionary principle is not regulated in the Financial Services Authority Regulation Number: 77/POJK.01/2016 regarding information technology-based lending and borrowing services. 2) The existence of legal protection has a preventive and repressive nature for users of Fintech Peer to Peer Lending services. Suggestions in this research are 1) The government can review the OJK Regulation Number: 77/POJK.07/2016. 2) Can make special regulations in order to form a Financial Technology dispute resolution institution (FINTECH).
