| Summary: | The issue of abuse in the family environment is no longer a secret it is proven by the reports in the media which includes cases of abuse like this is difficult to uncover because it is still considered taboo to be disseminated. Based on the above, the problems that the author will suggest in writing this research are, How are the proofs and obstacles to proof in the crime of child molestation? The purpose of this study is to find out howto prove related to cases of child molestation committed by the father and how the obstacles and efforts to prove criminal acts of sexual abuse in the family against children committed by the father. In this paper the authors obtain the necessary data through literature study and interviews. The nature of this writing is analytical descriptive, which is a method that takes written data to be described in order to obtain a comprehensive picture and understanding. The result of thisreaserch isthat Lawnumber 8 Of 1981 about KUHAP hasits own evidentiary system formulation as stated in article 184 KUHAP. However, regarding the legal regulations of evidence in the crime of child molestation, the witness testimony of child victims does not have the power of proof and the victim's mother has a mental disability wo cannot be sworm in. furthermore, there are several obstacles in proving the crime, one of which is not immediately implementing VeR and VeRP after the incident is reported and there are still many police investigators who do not understand how to handle child cases. There are also efforts that can be made to overcome these obstacles, one of which is to do a visa as soon as possible |
