| Summary: | Tender conspiracy is the action of business actors and/or other parties to achieve personal gain that ultimately harms other tender participants. This action violates Article 22 of the Business Competition Law. The purpose of the tender is to obtain goods and services at low prices and of good quality and with good intentions and intentions. This research uses the library method or also known as normative juridical, and the approaches used are the Statute Approach and the Case Approach. This research deals with tender conspiracy in terms of the Business Competition Law and examines horizontal tender conspiracy carried out by business actors or bidders in the construction of the swimming pool building phase II Kandangan, Hulu Sungai Selatan Regency, South Kalimantan. The horizontal conspiracy was carried out by the Reported Party I (PT. Cahayahikmah Jayapratama), the Reported Party II (PT. Karya Kandangan Nasional), and the Reported Party III (PT. Diang Ingsun Mandiri) in the construction of the swimming pool stage II of the cage, which then in its decision the Reported Party I paid a fine Rp1,35,000,000.00, Reported Parties II and III are prohibited from participating in the tender. |
