Description
Summary:The purpose of this study is to analyze the legal protection of the abbreviations of famous people's names in Trademarks. In Indonesia, the protection of the use of abbreviations of famous people's names in Marks is regulated by Law (UU) Number 20 of 2016 concerning Marks and Geographical Indications. Here, the DJKI is responsible for conducting a substantive examination of the use of abbreviations of famous people's names in applications for Trademark registration. However, there are still disputes over the use of abbreviations of famous people's names in Trademarks without the permission of those entitled, as happened in case Number 48/Pdt.SusHKI/Merek/2018/PN Niaga Jkt.Pst, and case Number 57/Pdt.Sus-Hki/ Brand/2019/Pn.Niaga Jkt.Pst in conjunction with Supreme Court Decision Number 575 K/Pdt.Sus-Hki/2020. From this research, it was found that, firstly, legal protection for the abbreviations of famous people's names in Trademarks based on the Marks and Geographical Indications Law is divided into preventive and repressive protections. Second, the responsibility of DJKI for the protection of abbreviations of famous people's names in Trademarks starts from registration, inspection to the issuance of Mark certificates. The emergence of two cases of the use of abbreviations of famous people's names in Marks shows that the responsibilities carried out by DJKI are not running properly. DJKI must conduct a thorough, thorough examination, and apply the precautionary principle. This writing uses a normative legal research method with an approach to the theory of justice by Aristoteles and the theory of legal protection by Satjipto Rahardjo in its analysis.
