Summary:The State of Indonesia in 2020 carried out executions of the death penalty by shooting as many as 117 death penalty sentences. The death penalty is one of the effective ways to prevent the occurrence of a criminal act, but there is still an assumption that the execution of a death row inmate by shooting is an inhumane method because it causes extreme pain to the convict before death and tends to contradict Law No. 39 of 1999 concerning Human Rights. It is necessary to find a formula for the execution of the death penalty which is considered humane through reducing pain for the defendants of the death penalty so that it is considered not contrary to human rights. The problems raised in this study are first to discuss the regulation of death penalty for death row inmates according to Indonesian law and secondly the implementation of death penalty for death row inmates which can be seen as more humane and reduce human rights violations. The method used in this research is a normative legal research method which is carried out by describing the legitimacy of legal principles and theories in accordance with applicable regulations. In this study, the type of data collected by the author consists of secondary data. The data that has been collected is then analyzed descriptively qualitatively, namely analyzing the data that has been collected. The results of the study show that firstly, normatively executions of death row inmates in Indonesia are carried out by shooting as per the Regulation of the Head of the Indonesian National Police Number 12 of 2010 concerning Procedures for the Implementation of the Death Penalty. Second, the death penalty for death row convicts that can be seen as more humane and reduces human rights violations is by giving the death row convict a choice of execution method by lethal injection or shooting.
