| Summary: | Name is the most important thing in someone's identity. Any changes and additions in identity must be reported so that a person's residence record is always correct. This includes changes of name. In the case of determination Number 42/Pdt.P/2020/PN Plk, where the applicant is a woman and she only wants to change her name from Nadya Tri Nur Rohim to Adham Al-Ghofur, her name cannot access public services and she feels more suitable, more comfortable using the name she is applying for change. So, the problem in this thesis was how were the religious norms and politeness about names in society, and how is the case determination Number 42/Pdt.P/2020/PN from human rights. The research method was normative juridical. The results showed that in Islamic religious norms and in the customary norms of the Dayak tribe the requested name by the applicant and the applicant himself is not appropriate and this is a violation. This is based on sources of Islamic law, the Qur'an and hadith, as well as the traditions of the Dayak tribe. Although it was true that the applicant's reasons included self-development and personal freedom rights, in Human Rights there were restrictions, that the fulfillment of a right must be in accordance with religious norms and decency, as well as respecting other human rights and considering public order.
