The age of covid has changed things. there are so many who have been affected by this covid, one of which is the economy in the community. There are not a few people who end up reducing their income, and even losing their jobs. This is what drives the crime rate to increase. One of them is theft. Theft is a criminal act that occurs, which is included in the crime against property or property owned by a person. One of the theft cases is theft that occurred in an empty house in the jurisdiction of the Kebon Jeruk Police Station. The West Jakarta District Court has decided the case in Decision Number 458/Pid.B/2021/PN.Jkt.Brt. The purpose of this study is to determine the application of criminal law in theft cases with continued restraint and legal considerations of judges in deciding cases of Decision Number 458 / Pid.B / 2021 / PN.Jkt.Brt. the method used in this study is normative legal research, using a statute approach, a conceptual approach, and a case approach. In this study, defendant Ali Wijaya Bin Mat Ali was found guilty of committing a criminal act of theft with continued restraint with a prison sentence of 4 years. Theft is accompanied by an element of stoning, as well as continued theft which means that the theft is committed more than once. In addition, in this study there is a comparison of criminal law, the comparison in this study is the case of Judgment No. 834/Pid.B/2020/Pn.Blb. With the same regulation, with much less loss but received the appropriate punishment.
