Summary: | Diversion is one of the diversions in the settlement of children's cases from the criminal justice process to a process outside the criminal justice system. In essence, children cannot regulate their own will. Children must receive parental guidance. Juvenile criminal justice is a court that specifically handles child criminal cases. In writing this thesis, the method used by the author in this research is a normative legal research method. Normative legal research (legal research) is usually "only" a document study, which uses sources of legal material in the form of laws and regulations, court decisions / decisions, contracts / agreements / contracts, legal theories, and opinions of scholars. Normative legal research or doctrinal legal research or dogmatic legal research or legal research which in the Anglo American literature is referred to as legal research is an internal research within the discipline of law. Diversion requirements as regulated in Article 7 of the SPPA Law are the choice of the state in resolving cases through the judiciary as an option.. In this case, I will discuss one by one the procedures for implementing diversion from each law enforcement officer. Both the Indonesian National Police, the Indonesian Attorney General's Office, the Indonesian Supreme Court, the Director General of Corrections at the Ministry of Law and Human Rights. Diversion for children must also consider elements of the interests of the victim, the welfare and responsibility of the child, avoidance of negative stigma, avoidance of retaliation, social harmony and propriety. decency and public order.
