Summary:The Indonesia Corruption Watch (ICW) released the most recent report on the prosecution of corruption cases in Indonesia, which showed the significant growth from 2017 to 2021, reaching over 200 (two hundred) cases. As a consequence of this significant increase, serious corruption eradication efforts are required, not only through investigations and improved regulations, but also through a restorative approach involving the recommendations of people who work as legal collaborators. Another problem in prosecuting corruption cases is that there are no guidelines for punishing Justice Collaborators, probably resulting in a criminal disparity. For example, in the awarding of gifts for lobster cultivation and export licenses for BBL, the penalty for compensation is money for the profits received, whereas in the case of tax bribery for receiving PT WAE restitution, no substitute money penalty is imposed even though receive benefits. This research uses normative juridical research methods, namely research methods by analyzing library data using primary and secondary legal materials.The statutory approach, the case approach, and the conceptual approach were all used in this research. The findings of this study show that there are a number of factors that contribute to criminal disparities among Justice Collaborators, one of which is the absence of criminal guidelines that govern the general foundation for punishment and protection of Justice Collaborators. As a result, it is necessary to formulate sentencing guidelines to minimize the possibility of sentencing disparities so that the fulfillment of rewards or awards for Justice Collaborators can be fulfilled without causing victims of injustice.
