Indonesia is a democratic legal state. In realizing this, elections are held as a form of the democratic process. The democratic process is also carried out at the regional level, namely the regional elections. Along with its development, regional elections are held simultaneously in 2024, but in the implementation order, it results in a vacancy for regional heads whose term of office expires ahead of the 2024 simultaneous regional elections. So an acting regional head is appointed to fill the void. The research method is normative juridical which is qualitative, based on literature research. Sources of data in the form of primary data, secondary and tertiary. Data analysis using the statute approach, conceptual approach, and comparative approach. The results of the study found that the appointment of acting regional heads ahead of the 2024 simultaneous regional elections is not following democratic principles, by not involving the people in decision-making. The appointment of the acting regional head led to a setback in democracy. That there are ways that can be taken as an alternative to the appointment of the acting regional head, such as by involving the role of the DPRD, the election of the acting regional head in the DPRD, extending the term of office of the regional head which expires ahead of the 2024 simultaneous local elections and the relevance of the appointment of the acting regional head for the new autonomous region results of the expansion.
