Summary:The understanding of intellectual property in Indonesia has accelerated, especially for business purposes. Trademark is an identity and an important asset that can give its own characteristics to the product when it is in the market. However, in practice Indonesia is still one of the countries with the lowest intellectual property protection in the world, reflected through the many cases of trademark infringement, as happened in MS Glow v. PS Glow. The purpose of this study is to analyze the registration of cosmetic tradmark that have similarity in principle with well-known cosmetic trademark. This research is a juridical-normative research, presented in the form of qualitative analysis, sourced from literature studies and case studies of primary, secondary, and tertiary legal materials. The results of this study show that legal protection for owners of well-known cosmetic trademark, related to the registration of other cosmetic trademark that have similarity, is basically regulated in Law No. 20 of 2016 concerning Trademark and Geographical Indications, which consists of legal protection before (preventive) and legal protection after (repressive). In addition, the form of responsibility of the DGIP for the issuance of cosmetic trademark certificate that have similarity in essence with well-known cosmetic trademark can be seen through two forms, absolute responsibility (collective) through the implementation of court decisions and culpability (individual) which can be done through the Ombudsman report.
