| Summary: | As a rule of law, Indonesia must provide legal protection and also provide justice for each member of society without discrimination, as stated in the and Pancasila and also as the purpose of the law itself. The research method used in this study is a type of normative juridical research using a statutory approach. This study aims to produce research that can explain legal protection efforts for victims of criminal acts of fraud and how victims of criminal acts of fraud can obtain compensation/refund for their losses. Cases of criminal acts of fraud that are still ongoing, often cause losses to victims. The results of the study stated as victims of criminal acts, the community received legal protection that had been regulated in the law in accordance with the crime. For the recovery of losses or refund, this is included in the slices of criminal and civil law. Both of these laws can be applied in resolving cases of recovering losses. There are 3 ways that victims can get compensation/refund for their losses, namely by merging compensation cases in accordance with the provisions of Article 98 of the Criminal Procedure Code, filing civil lawsuits, and restitution in accordance with the rules in the witness and victim protection law. |
