Summary: | The use of nuclear weapons has changed the world's view of the rapid development of weaponry. The Hiroshima-Nagasaki nuclear bomb tragedy resulted in a very large number of victims, so there is awareness from the international community to regulate the use of nuclear weapons. However, in its implementation, this regulation has not effectively applied to all holders of nuclear weapons. This research is made by focusing on the discussion to examine the regulation of the use of nuclear weapons contained in International Treaties and the efforts that can be made by the Security Council so that the Resolutions issued can be implemented properly by approaching the North Korean case. This research uses the Normative Juridical method using secondary data and approaches the case of North Korea. The results of this study indicate that International Law itself has recognized the principle of non-proliferation of nuclear weapons and accommodated it into various International Treaties. The existing International Treaties also accommodate jus cogens norms to strengthen legal certainty in restraining the use of nuclear weapons. To ensure more effective compliance with the resolution, there must be concrete steps in sanctioning countries that are bound by the resolution but refuse to comply with the rules contained. These sanctions can be in the form of economic embargoes, suspension of rights or expulsion as a UN member, or military sanctions. Therefore, international law plays a significant role in limiting the use of nuclear weapons through international treaty and the norm of jus cogens, while the Security Council can impose sanctions and engage in diplomatic negotiations to ensure compliance by countries like North Korea with nuclear non-proliferation resolutions. |
