520 |a Promotion is an important and closely related part of the development of the economic sector in today's society, where promotional media is increasing rapidly and significantly every year. Promotion is used as a means to convey information and communication about advertised products or services to the wider community. This study aims to conduct a study related to the misleading promotion of the Binary Option Binomo case and the responsibilities of the perpetrators who carry out misleading promotions. This study uses a normative juridical approach research method supported by secondary data. In normative legal research, secondary data sources are used, namely books, laws and regulations, legal theories. In addition, this study uses secondary data related to Binary Options Binomo. The results of this study indicates that the form of legal protection for consumers who have been harmed by Indra Kesuma is by providing accountability to the perpetrators in offering or promoting Binomo through social media including spreading false and misleading news that violates the provisions of Article 28 paragraph (1) of Law Number 19 of 2016 concerning Amendments to Law Number 11 of 2008 concerning Information and Electronic Transactions and violates consumer rights contained in Law Number 8 of 1999 concerning Consumer Protection in Article 8, Article 9 and Article 17 that there is a prohibition for actors in producing advertisements that contain false or misleading information. Because of this, perpetrators who violate the provisions of the law in force must be responsible for causing consumer losses with the threat of imprisonment for a maximum of 6 (six) years and/or a fine of up to Rp. 1,000,000,000.00 (one billion rupiah)".
