Bloody conflicts and violence in countries such as Iraq, Iran, Afghanistan, Sri Lanka, Pakistan, and Myanmar have forced many individuals to become refugees and seek protection in other countries. These refugees often face irregular immigration processes, and their presence can pose threats to the sovereignty, security, and socio-economic well-being of a nation. The issue of migration and immigration, particularly concerning refugees from foreign countries in Indonesia, demands serious attention. This study employs a normative juridical research method, examining legal provisions relating to the research object based on existing facts. The research methodology involves analyzing the non-refoulement theory regarding the duration of stay for refugees from foreign countries in Indonesia. The researcher analyzes that these refugees should not be returned to their home countries unless they are involved in criminal activities or disrupt public order. Clear and updated regulations are necessary to govern the duration of stay for refugees, considering the increasing number of refugees and the socio-economic impacts they bring. Furthermore, coordinated efforts between international organizations such as the United Nations High Commissioner for Refugees (UNHCR) and the International Organization for Migration (IOM) are crucial to effectively address this issue. A comprehensive approach is needed to tackle this problem, encompassing the protection of refugees' human rights, improved shelter facilities, and collaboration with destination countries for migration. Additionally, further research can be conducted to analyze the impact of migration on national security and stability, as well as to identify implementable solutions to address these challenges.
