| Summary: | Interfaith marriage in Indonesia has always been a separate debate, especially legal, social, religious and cultural debates. Registration of interfaith marriages is carried out by submitting to the religion of one of the parties. An interpretation arose after the entry into force of the Supreme Court circular letter Number 231/PAN/HK.05/1/2019 in interpreting the religious submission of one of the parties, because a valid marriage based on Article 2 paragraph 1 of the Marriage Law is "Marriage is valid, if it is carried out according to the laws of each religion and belief." The Supreme Court circular letter has two different interpretations in its implementation in several Dukcapil, namely religious submission without requiring a change of religious identity on identity cards and religious submission must be accompanied by a change of religious identity on identity cards. This research is a normative juridical research with secondary data supported by interviews. the interpretation of the registration of interfaith marriages after the enactment of the supreme court clerk circular letter number 231/pan/hk.05/1/2019, has led to ambivalence where there are different interpretations in some Disdukcapil regarding religious submission and identity change. Juridical review of religious conversions by the state due to interfaith marriages due to religious submission is interpreted as proof that marriages are carried out with one religion. |
