Summary

Divorce is a common thing happening in society, hence embodying regulations regarding the said topic in Law Number 1 of 1974 about Marriage. One of the problems revolves around divorce is when there are disparities in the decisions of judges in dealing with divorce caused by the apostasy of one of the marriage partners. Based on this explanation, the author examines several reasons for disparities in judges' decisions, the factors that cause disparities in judges' decisions, and also the relationship between Islamic law and civil law that applies in Indonesia. This research explains the differences between these two decisions from the perspective of the judges internally, which reflects the gap in legal interpretation and examination of legal facts. In addition, weaknesses in the sensitivity of the main legal references, namely the Marriage Law and the compilation of Islamic law, which also contribute to this gap.
