| Summary: | The purpose of this writing is to determine the views of health-related laws on the phenomenon of the circulation of syrup drugs that cause acute kidney failure in children and to determine the form of BPOM legal responsibility for this phenomenon. This research method uses normative juridical method using literature to search for concepts, theories, opinions, and discoveries that have a close relationship with the subject matter in this study. The result of this study is that the circulation of syrup drugs is not in accordance with the provisions of the Health Act and How To Make Good Medicine. Then, the form of legal responsibility that can be done by BPOM is to strengthen the function of pre-market and post-market supervision of drugs in circulation and test drugs independently in addition to the weak supervisory function of BPOM regulated in the BPOM Presidential Regulation, it is necessary to ratify the draft law on drug and food supervision to strengthen the function, authority and regulation of sanctions for BPOM. |
