Of course, this is contrary to Government Regulation number 29 of 1980 concerning the implementation of the collection of donations at a maximum of 10% of the total donations, then how is the civil responsibility of the management of the misuse of donated funds for personal gain. This paper discusses the civil liability of the ACT foundation's organ and how the misuse of donation funds for personal use. In this writing, the author uses the Normative Juridical Method with a statutory approach. The results of data analysis in this study will be presented in qualitative analysis with descriptive analysis techniques, namely analyzing and explaining the various explanations presented from existing legal materials which then formulate a form of recommendations for improving legislation. This paper concludes that the actions of the ACT Foundation's organs are a violation that goes beyond the purpose of the Foundation and deviates from legal certainty, this Foundation also harms many parties so that the ACT Foundation's organs must be responsible for their actions and make compensation. ACT has fulfilled the elements of unlawful acts so that civil liability and demands must be fulfilled. Article 1365 of the Civil Code which states that every unlawful act, which brings harm to another, obliges the person whose fault caused the loss, to compensate for the loss.
