| Summary: | Constitution Number 15 of 2001 concerning about trademarks governs geographical indications in articles 56 to 58 as part of their substance geographical indications (IG). Basically regulates the protection of local community products as a sign indicating the area of origin of an item which, due to human factors, natural factors or a combination of these two factors, gives certain characteristics and qualities to the goods produced. Then the issuance of government regulation number 51 of 2007 regarding geographical indications to more clearly protect it as expected in the constitutional TRIPS Regulations as stipulated in article 33 paragraph 3 of the 1945 Constitution states "Earth and water and natural resources contained therein are controlled by the state and used for state and are used for as much as - the prosperity of the people ". This means that the people are given the opportunity to manage and utilize existing natural resources for the prosperity of the people. This is the form of the state that gives the people opportunity to explore potential of natural resources to be managed and used as economic value which will be used as property rights of the community, which are then attached to the basic ownership rights that cannot be separated from the wealth of human rights. |
