Description
Summary:This paper is about the principle of Utmost good faith in contract law between the Insurer and the Insured in General Insurance in dispute resolution at the Indonesian Insurance Mediation Agency, where the insurance business has been in the Indonesian economy for quite a long time and has played a role in the nation's history alongside other sectors of economic activity. Insurance is an agreement between the insurer who improves himself to the insured by receiving a payment called an insurance premium, which aims to provide protection in the form of compensation for loss, damage, or loss of expected profits that he may suffer due to an unforeseen event. In the insurance agreement, a dispute resolution clause is usually stated, where the parties agree to settle disputes that are carried out in a state court or at an insurance dispute settlement institution, namely; arbitration. In the insurance industry, because the form is an agreement between an insurance service provider and its users, sometimes discrepancies arise in the agreement period, for example when an insurance user wants to claim something insured, such as a motor vehicle or other insurance claim. In the insurance industry, the emergence of disputes or discrepancies is generally related to two (2) things, namely related to policy responsibility (liability) and the value of compensation (indemty of claim). Dispute Resolution Arbitration awards are final and binding on the parties (final and binding). In order for the arbitration award to have executive power, the decision within 30 (thirty) days after being read out must be registered with the District Court immediately.
